CPS Response to HMCPSI follow-up Inspection on Custody Time Limits, 30 November 2023
His Majesty's Crown Prosecution Service Inspectorate (HMCPSI) has today issued a report about the CPS’ handling of custody time limits (CTLs), following a recent inspection. This inspection specifically looked at, and reported against, the recommendations made in its previous CTL inspection of 2021.
The report recognises that we treat CTLs as a priority and continue to monitor and check these cases, even as the volume has increased to over 10,000 custody cases. It also acknowledges the ongoing challenges in managing CTLs due to the impacts of the pandemic and Bar action.
Recommendation
Despite the challenges, HMCPSI note there is still improvement to be made in fully embedding our monitoring system. It recommends that that by 31 December 2023, we must embed the consistent use and updating of the CTL case progression log, (including recording the weekly assurance review on the case management system (CMS)) in all cases. By 31 March 2024 we must also have developed a system of assurance to evidence improvement and monitor compliance with CTL policies.
CPS response
We accept the recommendation and will work with Area Senior Leaders to embed the process and provide Operations Directorate with assurance that the guidance is being followed.
