Ethnicity data for defendants and victims for rape, sexual assault and hate crime

Please can I have the statistics on perpetrators and victims by race and ethnicity of rape and sexual assault where the case has been solved between the years 2000-2008 and 2018-2023 in England and Wales taking the population into account for each ethnicity group.

Please can I also have the statistics on perpetrators and victims by race and ethnicity of gang rape/sexual assault where the case has been solved between the years 2000-2008 and 2018-2023 in England and Wales taking the population into account for each ethnicity group.

Please can I also have the statistics on perpetrators and victims by race and ethnicity of a hate crime where the case has been solved between the years 2000-2008 and 2018-2023 in England and Wales taking the population into account for each ethnicity group.

Also what does the statistics for the above NOT include?

Response

The Crown Prosecution Service (CPS) does hold and record some limited data that falls within the scope of your request.

I therefore attach for your reference an Excel spreadsheet labelled '12067 DATA’ and the caveats appended to that data should be noted when considering the disclosure.

The following should also be noted when considering the data regarding your first question:

2006/07 and 2007/08 – rape flagged data: The charge volumes and prosecution volumes are split by Self-declared ethnicity (SDE).  Please note that rape flagging did not centrally commence until April 2006.
2018/19 to 2022/23 – rape flagged data: The charge volumes and prosecution volumes are split by SDE.
2006/07 and 2007/08 – sexual offences excluding rape: prosecutions by SDE (charge volume data did not exist before April 2019).
2018/19 to 2022/23 – sexual offences excluding rape: prosecutions by SDE and for the pre-charge Principal Offence Category (POC) Sexual offences excluding rape charge volumes from 2019/20 to 2022/23.

Turning to your second question, the CPS has no recorded data that shows whether gang rape or gang sexual assault formed the offence(s).  

Finally, the following should be noted when considering the data regarding your third question: 
2005/06 to 2007/08 – hate crime flagged: The charge volumes and prosecution volumes are provided by SDE.
2018/19 to 2022/23 – hate crime flagged: The charge volumes and prosecution volumes are provided by SDE.

It is also important to note in the response that the list of SDE’s changed during February 2021 from 16+1 to 18+1.  I can also confirm that our Case Management System (CMS) was not fully implemented across the CPS until 2005, so it is not possible to provide data for earlier periods as previous CPS case management systems did not include such detailed breakdowns.
