UPDATED WITH SENTENCE: TikTok user found guilty of breaching online posting ban

A TikTok user has been found guilty of breaching a Criminal Behaviour Order after posting videos of people without their consent. He was sentenced on 21 November 2023 to a total of 18 weeks' detention in a Young Offender Institution and ordered to pay a £154 Victim Surcharge.

On 24 May 2023, Bacari O’Garro, 19, known as ‘Mizzy’ was handed a Criminal Behaviour Order following concerning behaviour online which put him in breach of a previous Community Protection Notice. Terms of the order included not to post any original content to social media without prior documented consent from those involved and not to attend Westfield Stratford City.

On 7 July 2023, whilst under arrest for an unrelated manner, police uncovered accounts on Twitter and Snapchat linked to O’Garro’s mobile phone numbers and email address. These accounts displayed several videos posted on and after 24 May 2023 showing O’Garro in breach of his Criminal Behaviour Order.

In one video, O’Garro is seen standing in Westfield Stratford City where he failed to obtain prior consent from members of the public captured in the video.

O’Garro appeared at Stratford Magistrates’ Court today (Thursday, 26 October 2023) where he was found guilty of two breaches of his Criminal Behaviour Order. He will return to Thames Magistrates’ Court for sentencing on 21 November 2023.

Varinder Hayre, of the CPS, said: “O’Garro initially breached the terms of his Criminal Behaviour order mere hours after it had been imposed. Through his deliberate actions, he has repeatedly shown a complete lack of respect for those around him and attempted to make a mockery of the British criminal justice system.

“The CPS remain committed to holding those in breach of court orders to justice and keeping the public safe.”

  • On 24 May 2023, a Criminal Behaviour Order was imposed at Thames Magistrates’ Court. The three terms of the order were:
    1. Not to upload directly or indirectly any original video content on social media including but not limited to: Facebook, Instagram, TikTok, twitter and YouTube without prior documented consent of the people in that content
    2. Not to trespass into any private property including residential homes, business properties, school and retail outlets
    3. Not to attend Westfield Stratford City
  • The first breach of Bacari O’Garro’s Criminal Behaviour Order took place on 24.05.2023 at 10.15 pm. The video uploaded onto Twitter showed O’Garro standing in Westfield Stratford City speaking directly to the camera.
  • The second breach of Bacari O’Garro’s Criminal Behaviour Order took place on and before 07.07.2023 by uploading the original videos on Snapchat without the documented consent of those appearing videos.
